1. Introduction

These Website Terms of Use (the "Terms") govern the rights and obligations that apply when using the website www.sportsevolutionbay.org (the "website"), operated by the civic association Sports Evolution Bay o.z. (the "operator" or the "association").

By using the website you agree to these Terms. If you do not agree with them, please do not use the website.

The website is primarily presentational and informational. It serves in particular to inform about the activities, projects and events of the association and to enable contact with the public and interested parties.

The operator reserves the right to change the scope and content of the website at any time and to temporarily restrict or discontinue its availability, without compensation. Use of the website is free of charge.

4. Intellectual property rights

The content of the website (text, photographs, graphics, logos, design, structure and source code) is protected by Act No. 185/2015 Coll. (the Slovak Copyright Act), as amended, and by other intellectual-property laws. The economic rights to the content are exercised by the operator or are held under licence.

Without the operator's prior written consent, the content may not be copied, reproduced, distributed, modified, incorporated into other works or used for commercial purposes. This is without prejudice to the right of quotation (Section 37), use of a work for teaching purposes (Section 41) or the news reporting licence (Section 38) under the Copyright Act.

The name and logo of the association identify its origin; any use by third parties requires prior consent.

5. Rules of use and prohibitions

Visitors undertake to use the website in accordance with the laws of the Slovak Republic and with these Terms. In particular, the following are prohibited:

• obtaining unauthorised access to the website's systems, parts, code or data (hacking, reverse engineering)
• automated data collection beyond what robots.txt permits (scraping, crawling)
• placing excessive load on the website's infrastructure (DoS/DDoS, mass queries)
• distributing malicious code (malware, viruses, phishing) or unsolicited communications
• collecting personal data of other visitors without their consent and a legal basis
• submitting content that infringes third-party rights or is unlawful, offensive, defamatory, or that incites violence, discrimination or hatred
• using the website in a way that may damage the reputation of the association

The website may contain links to third-party sites. The operator is not responsible for their content, availability, security or the way they process personal data. Following such links is at the visitor's own risk.

7. Disclaimer and limitation of liability

The content of the website is provided for informational purposes. The operator uses reasonable efforts to keep the information accurate and up to date, but does not guarantee its completeness, correctness or currency at any given moment.

The website is provided "as is", without any warranty. To the extent permitted by law, the operator is not liable for any damage arising from the use of the content, from interruptions of availability, from outages of third-party infrastructure (in particular the hosting provider Cloudflare, Inc. and the form services Formspree and Tally NV), or from improper use of the website by a visitor.

This does not affect statutory liability for damage caused intentionally or by gross negligence, nor liability towards consumers to the extent that it cannot be contractually excluded under Act No. 108/2024 Coll. on consumer protection and related consumer laws.

8. Hosting and infrastructure

The website is technically operated on the infrastructure of Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA (https://www.cloudflare.com), which provides hosting, CDN, DNS and protection against automated attacks.

The contact form on the website is technically processed by Formspree (USA) (https://formspree.io). Registration forms are technically processed by Tally NV, Outer Ring Brussels 4, 1090 Jette, Belgium (https://tally.so).

The processing of personal data in connection with the operation of the website and the forms is described in the Privacy Policy.

9. Personal data and cookies

The processing of personal data is governed by the Privacy Policy available on the website. The use of cookies and similar technologies is governed by the Cookie Policy available on the website.

10. Governing law and dispute resolution

These Terms and all relationships arising from them are governed by the laws of the Slovak Republic. The courts of the Slovak Republic have jurisdiction to hear any disputes.

Where the website provides services subject to consumer protection, the consumer has the right to turn to alternative dispute resolution before the Slovak Trade Inspection (https://www.soi.sk) or via the EU online dispute resolution platform (https://ec.europa.eu/consumers/odr). This does not affect the consumer's right to bring proceedings before the court of their domicile in accordance with Regulation (EU) No 1215/2012.

11. Severability

If any provision of these Terms turns out to be invalid, ineffective or unenforceable, the remaining provisions will continue to apply. The invalid provision will be replaced by one whose meaning most closely matches the original intent.

12. Changes to the Terms

The operator may amend these Terms at any time. The current version is always published on the website with its effective date. Where changes are material we will inform visitors in an appropriate way. Continued use of the website after the effective date of the changes constitutes acceptance of the amended Terms.

13. Final provisions

These Terms take effect on 1 July 2026 and replace any previous version.
